Contractors & Notarize Lien Waivers

Some homeowners find out the hard way about a lien against their property, when they are about to sell their house.  In most instances, a homeowner’s title insurance policy will make sure that all known liens against a property are addressed.  

In Florida construction, lien waivers act as legal shields, serving as safety nets to manage project risks, ensure fair compensation, and maintain solid legal footing for all parties involved. This is especially true when there are several subcontractors involved in a project, such construction of a pool or remodeling of your home. These waivers allow parties to release their right to file a construction lien against a property in exchange for payment or other considerations. Essentially, a lien waiver is more than a receipt that confirms payment for work or materials on a job.  Keep in mind that while statutory lien waiver forms are recommended, parties can agree to use alternative forms.


In Florida, there are two primary types of construction lien waivers:


Partial Waiver and Release of Lien : This type of waiver is used when a contractor, subcontractor, or supplier receives a partial payment for work done on a construction project. By signing this document, the contractor, subcontractor, or supplier agrees to waive and release their right to file a lien against the property for the amount of the payment received.


Final Waiver and Release of Lien : This type of waiver is used when a contractor, subcontractor, or supplier receives full payment for work done on a construction project. By signing this document, the contractor, subcontractor, or supplier agrees to waive and release their right to file a lien against the property for the full amount owed.
